What is Theft?

A person commits the crime of theft by knowingly, and without lawful authority, taking any of the following actions:

  • Controlling another person’s property with the intent to deprive them of the property;
  • Using another person’s property or services for an unauthorized period of time;
  • Obtaining another person’s property or services through material misrepresentation (i.e. fraud);
  • Controlling lost property without reasonably attempting to find its owner
  • Controlling stolen property, or
  • Obtaining compensable services without paying or agreeing to pay for the services.

Class 1 Misdemeanor Theft

A Class 1 Misdemeanor Theft is the theft of any property or services valued at less than $1,000, and is the lowest-level theft offense under Arizona law.

  • Punishable by up to 6 months in jail, a $2,500 fine (plus surcharges), and three years of probation. The court may also order the offender to reimburse the theft victim for the value of the stolen property.

Note that if the defendant took the property directly from the victim or if the property was a firearm or an animal for purposes of animal fighting, the theft may be heightened to a class 6 felony, regardless of the value of the property.  For class 6 felony penalties, see below.

Class 6 Felony Theft

A Class 6 Felony theft is the theft of any property or services valued between $1,000 to $2,000.

  • Punishable by up to 2 years in prison, $150,000.00 in fines (plus surcharges), and three years of probation.

Class 5 Felony Theft

Theft of property or services valued between $2,000 to $3,000.

  • Punishable by up to 2.5 years in prison, $150,000.00 in fines (plus surcharges), and three years of probation.

Class 4 Felony Theft

Theft of property or services valued between $3,000 to $4,000.

  • Punishable up to 3.75 years in prison, $150,000.00 in fines (plus surcharges), and four years of probation.

Class 3 Felony Theft

Theft of property or services valued between $4,000 to $25,000.

  • Punishable up to 8.75 years in prison, $150,000.00 in fines (plus surcharges), and five years of probation..

Class 2 Felony Theft

Theft of property or services with a value of $25,000 or more.

  • Punishable up to 12.5 years in prison, $150,000.00 in fines (plus surcharges), and seven years of probation..

Any prior criminal conviction on a defendant’s record (for a theft-related offense or for any other misdemeanor or felony) may lead to harsher punishments at the time of sentencing for a subsequent offense.
